Due to the current situation of rapidly changing prices, it is possible that some prices do not correspond to the current value. If this is the case for the item you have ordered, we will inform you and, if you wish, you can cancel your order.

Availability: In general, we anticipate the arrival of products and insert them in the store according to the lead times announced by suppliers. However, some delivery times are still difficult for our suppliers to meet, and items marked "Available from stock" may not yet have arrived. In such cases, you will be directed to an equivalent alternative, or you can wait for delivery of the item, or cancel your order.

1. Scope of application:
The following General Terms and Conditions of Sale (GTCS) define the contractual relationship between Lathion Frères SA and the customer for any order or purchase of goods.

2. Right of return:
The customer has a right of return of 7 (seven) days from the date of receipt of the goods. Goods must be returned unused and in their original packaging. The following items:
Gift vouchers, diving lamps, accumulators, swimwear, clothing, heating systems, jewelry, filters, optical lenses, optical glasses, photo-video boxes, masks, swimming goggles, as well as items in action, in liquidation, or for which the guarantee form has already been completed, may not be returned or exchanged.

Items "ordered specially for the customer" or marked "On order, This is not a stock item" cannot be exchanged, returned or refunded. Errors such as the publication of an incorrect photo, or an error in the price or descriptive text, do not entitle the customer to a refund.

3. Return of goods:
Before returning goods to Lathion Frères SA , it is essential to contact us to clarify the return procedure. We reserve the right to invoice the customer for any additional costs associated with the return of goods. When goods are returned, the post office will provide the customer with a receipt, which must be kept in a safe place: if the shipment is lost, it cannot be traced without this receipt. Please note that all returns (unless exchanged) are subject to a processing fee of 10% of the item concerned, or a minimum of CHF 10.00 . Shipping costs for exchanged items will be billed to the customer.

4. Deliveries within Switzerland:
For orders delivered within Switzerland, the applicable VAT is already included in the price.

5. Deliveries abroad:
Shipments abroad are made exclusive of tax (HT). The consignee must pay the applicable duties or taxes directly upon receipt of the goods in his country.

6. Transfer of responsibility:
Responsibility for the article passes to the customer as soon as the goods have left our premises. Any claim or request for compensation (damaged item, loss, delay, non-delivery, etc.) must be made directly to the carrier.

7. Quality warranty:
Unless otherwise specified in the product instructions, the manufacturer offers a 24 (twenty-four) month warranty on new products, and a 6 (six) month warranty on batteries or accumulators. Shipping costs or any other expenses incurred by the application of the warranty are not covered by it; depending on the situation, such costs may be invoiced to the customer. Second-hand items are not covered by warranty.

8. Delivery costs and conditions:
Orders are delivered by Swiss Post, preferably in Priority mode and with registration. Lathion Frères SA accepts no liability for late, lost or undelivered goods.

9. Data protection:
Lathion Frères SA undertakes to comply with all applicable data protection laws.

10. Place of jurisdiction:
Business activities and relations between Lathion Frères SA and the customer are governed by Swiss law. For customers residing abroad, Sion is the place of application of criminal law and the only recognized place of jurisdiction for any proceedings.

11. Final clause :

Lathion Frères SA reserves the right to modify these terms and conditions at any time.
